JAKARTA, SELEBRITYNEWS – Rektor IAIN Ambon, Prof. Zainal Abidin Rahawarin mendapat sorotan dari berbagai pihak.

Pasalnya, Rahawarin diketahui secara aturan tidak memenuhi syarat pencalonan sebagai Penjabat Gubernur Maluku.

Sehingga hal itu menyita perhatian sejumlah pihak, salah satunya Maluku Spicy Island (MSI).

Ketua MSI, Sabri Leurima dengan tegas mengatakan agar Rahawarin lebih baik mundur dari pencalonan kalau belum memenuhi syarat.

“Jangan paksakan kondisi, nanti malu sendiri. Lebih baik mundur saja,”kata Sabri di Jakarta, Sabtu, 16 Desember 2023.

Selain itu, Sabri menjelaskan bahwa persyaratan untuk menjadi seorang pemimpin di Maluku adalah satu tolak ukur masyarakat.

“Nah, kalau di persyaratan saja sudah bermasalah bagaimana nanti ke depan,”pungkasnya.

Pegiat HAM itu pun membeberkan agar sebaiknya Rahawarin lebih fokus untuk mengurus dunia akademis dari pada turut serta namun hasilnya tidak sesuai harapan.

“Mau berperang tapi amunisi belum siap, mendingan urus kampus saja Pak itu lebih produktif,”ujar Sabri.

Dikutip dari Ameks Online, Zainal Rahawarin sendiri, secara aturan tidak penuhi syarat, jika acuan rekrutmen pejabat Gubernur Maluku berdasarkan Peraturan Menteri Dalam Negeri Nomor 4 tahun 2023. Zainal dalam jabatan sebagai Rektor IAIN Ambon, bukan dalam posisi Jabatan Pimpinan Tinggi Madya (JPT Madya).

JPT Madya adalah jabatan yang meliputi sekretaris jenderal, direktur jenderal, inspektur jenderal, kepala badan, staf ahli menteri, dan jabatan lain yang setara eselon I.

Sementara, Pakar Hukum Tata Negara (HTN) Universitas Pattimura, Sherlock Halmes Likipeuw mengatakan, sesuai Peraturan Menteri Pendidikan, Kebudayaan, Riset dan Teknologi (Per- mendikbudristek) nomor 1 tahun 2015, pasal 1 angka 2, rektor disebutkan sebaga Pimpinan Perguruan Tinggi.

Terkait dengan Penjabat Gubernur, jelas Sherlock, sesuai dengan pasal 3 Permendagri 4/2023, salah satunya adalah pejabat ASN atau pejabat pada jabatan ASN tertentu yang menduduki JPT Madya di lingkungan Pemerintah Pusat atau di lingkungan Pemerintah Daerah bagi calon Pj Gubernur.

“Pertanyaannya apakah rektor termasuk dalam kelompok jabatan JPT Madya ataukah tidak? Dalam rujukan UU ASN dan Peraturan pelaksanaannya, JPT Madya merupakan kelompok jabatan bagi ASN yang diatur dalam pasal 14 huruf b. Juncto pasal 48 dan 120 PP 11 ta- hun 2017. Dengan rujukan norma di atas, rektor tidak masuk dalam kategori JPT Madya,” jelas Sherlock. **
