Selebritynews.id | Jakarta – Indonesian Royalty Watch (IRW) menyebutkan jika Indonesia tidak mengenal istilah Direct License (Pembayaran Royalti langsung ke pencipta) sesuai Undang Undang Hak Cipta (UUHC) Nomor 28 Tahun 2014. Harus melalui Lembaga Manajemen Kolektif (LMK)/Lembaga Manajemen Kolektif Nasional (LMKN).

“Jadi jika ada pencipta lagu menyebutkan pembayaran royalti secara langsung (Direct License), Indonesia berdasarkan UUHC 28 tahun 2014 tidak mengenal itu. Semua telah diatur melalui mekanisme lewat LMK/LMKN, Peraturan Pemerintahannya dan Peraturan Menteri,” tegas Ketua Umum Indonesian Royalty Watch (IRW), HM. Jusuf Rizal, SH kepada media di Jakarta

Penjelasan Jusuf Rizal, pria berdarah Madura-Batak itu disampaikan menanggapi pertanyaan media terkait pelaporan penyanyi Agnes Monica yang dilaporkan pencipta lagu Ari Bias bersama pengacaranya, Minola Sebayang ke Bareskrim Mabes Polri dan Pengadilan Niaga Jakarta atas pelanggaran UUHC Pasal 9 Ayat 1,2 dan 3, menggunakan lagu tanpa izin.

Sebagaimana diketahui publik dalam konser Agnes Monika di tiga kota yaitu Jakarta, Bandung dan Surabaya telah membawakan satu buah lagu ciptaan Ari Bias. Atas penggunaan lagu tersebut, Ari Bias merasa tidak pernah memberikan izin, sebab Ari Bias memberlakukan Direct License setiap lagunya. Ia juga mengaku tidak memperoleh Royalti atas penggunaan lagu ciptaannya yang digunakan.

Pihak Ari Bias sudah melakukan somasi ke Agnes Monica namun tidak ditanggapi. Atas penggunaan lagu yang dibawakan di tiga kota tersebut, Ari Bias meminta pembayaran royalti sebesar Rp.500 juta tiap kota atau total Rp.1,5 milyar. Hingga pihak Ari Bias melaporkan ke Pengadilan Niaga Jakarta, Agnes Monica juga tidak merespon.

Menurut IRW ada beberapa hal yang mungkin membuat Agnes Monica tidak menanggapi somasi, pelaporan ke Bareskrim Mabes Polri dan Pengadilan Niaga Jakarta atas pelanggaran UUHC Pasal 9 ayat 1,2 dan 3 yang dilakukan pihak Ari Bias didampingi pengacara Minola Sebayang

Pertama, kata Jusuf Rizal, Agnes Monica barangkali merasa tidak melakukan pelanggaran UUHC sebagaimana dituduhkan. Karena bisa saja Agnes Monica menggunakan Pasal 23 UUHC Ayat 5 yang berbunyi setiap orang dapat menggunakan ciptaan secara komersial dalam suatu pertunjukan tanpa izin terlebih dahulu kepada pencipta dengan membayar imbalan/royalti kepada pencipta melalui Lembaga Manajemen Kolektif (LMK) dimana pencipta bernaung.

Kedua, sesuai UUHC Pasal 87 siapapun tidak dilarang menggunakan hasil ciptaan orang lain secara komersial asal telah membayar royalti kepada pencipta atau pemegang hak cipta melalui Lembaga Manajemen Kolektif (LMK). Artinya setiap orang boleh menggunakan lagu ciptaan siapapun asal memenuhi sebagaimana Pasal 87 UUHC.

Bukankah di Pasal 9 jelas dilindungi hak eksklusif pencipta lagu, tanya media.

Betul UUHC Pasal 9 telah melindungi dan mengakui jika hak moral dan hak ekonomi para pencipta dilindungi UUCH. Tapi Pasal 9 itu tidak berdiri sendiri. Perlu pengaturan teknis yang dijabarkan di Pasal 23 UUHC dan pembayaran royaltinya diatur di Pasal 87 serta Peraturan Pemerindan dan Peraturan Menteri.

“Jadi menurut IRW laporan ke Bareskrim Mabes Polri dan Pengadilan Niaga Jakarta oleh Ari Bias atas pelanggaran UUHC jika hanya berdasarkan Pasal 9 UUHC masih lemah. Karena bisa saja Agnes Monica telah membayar royalti sesuai ketentuan Pasal 23 dan 87 UUHC,” tegas Jusuf Rizal, Ketua LBH LSM LIRA (Lumbung Informasi Rakyat) itu.

Ketiga, lanjut Jusuf Rizal, Indonesia sesuai UUHC tidak mengenal istilah Direct License (Pembayaran Langsung) Royalti kepada para pencipta atas lagu ciptaannya yang digunakan secara komersial. Karena UUHC telah mengatur secara jelas di dalam UUHC agar para pencipta lagu hak moral dan ekonominya terlindungi secara umum (berlaku untuk semua)

Jika ada pencipta lagu memproklamerkan bahwa setiap lagu ciptaannya jika mau digunakan secara komersial harus dengan cara Direct License, menurut IRW justru itu merupakan pelanggaran UUHC.

Kalau tidak setuju dengan UUHC 28 Tahun 2014, pilihannya hanya ikut aturan atau keluar dari Indonesia. Jadi pencipta lagu dapat mengikuti aturan dinegara yang menggunakan Direct License untuk pembayaran royalti. Atau bisa dengan mengubah UUHC 28/2014. Sepanjang belum ada perubahan, siapapun harus tunduk pada UUHC 28/2014.

“Justru menurut IRW jika pencipta lagu memaksa para pengguna lagu ciptaannya harus membayar royalti langsung (Direct License) dapat dilaporkan sebagai pelanggaran UUHC. Dalam kasus Agnes Monica, Ari Bias bisa dilaporkan juga atas pelanggaran UUITE 27A, jika ternyata Agnes Monica telah melaksanakan Pasal 23 Ayat 5 dan Pasal 87 serta Peraturan Pemerintah dan Permen,” tegas Jusuf Rizal, Ketum Indonesian Journalist Watch (IJW) itu.
